Guy intentionally sideswiped me, totalled?

Long story short a guy got road rage with me today and rammed my car then tried to attack me but I was more than twice his size. He got charged with careless and reckless, leaving the scene of an accident and more charges are coming. There is damage to the rear 1/4, both doors are bashed in, passenger front door will not open, crash bar bent on right corner, wheel fed up etc. The car is a 17 SEL with 8000 miles. I believe it might be very close to being totaled if not there, but no airbags went off.

Very unlikely that is totaled.
No airbags went off. two new doors, front fender. front bumper maybe some suspension parts. paint.
That front end horror is just the bumper pulled off. No big deal actually.
However..
With the other driver being 100% at fault.
IF he has insurance.. They should
Make you whole. Also the money for the difference between what your car was worth, vs what it is worth with an accident. You have the right to be made 'whole'.
Which might mean with a near new car with only 8,000 miles.
To replace your car.
Or if YOU have 'new car replacement'?

So it all depends on your state laws about insurance.
And did the other person HAVE insurance.
Have you gotten his insurance info from the cops?
Was he drunk?

He has Nationwide, already filed a claim. My wife's 14 had a simple bumper cover as well, was $3400 in damage a few years back. These cars are being fire saled right now. Will probably be going to my dealers body shop after I talk to the adjuster.

The bumper being loose means most likely every attachment point torn loose, likely looking at replacement of that as well, they don't just 'pop off'.

I also have a witness that stayed on scene and backed my story to the cops. I am usually armed, glad I was not today.

I want to know what REALLY happened to set him off from his point of view. I've gotten pretty angry and aggressive before but never intentionally hit anyone. Whew!

I know we likely won't get a straight story from one side, it never happens that way, but it would be interesting to hear.

That is far and between. A ******* cab driver bumped me the other day because he was in a rush. Then said its no big deal and he needs to get his passengers to airport and that just a Little wd40 will take marks off my bumper.

Talked to Nationwide, they are saying that if he hit me intentionally they will deny the claim because they do not cover intentional accidents. On top of that it will be 4 weeks before they make a determination.

Part of this may be just the wording of the claim.
IF you had said he was driving erratically or someing and left OUT the words 'He hit me INTENTIONALLY"
You might have been covered.

So for ANYONE to remember: it SOUNDS good to say: 'Hit hit me on purpose" But in reality is is a big mistake to say it. Just say he was driving erratically... Huge difference. And his insurance WOULD have paid out.

Sorry to hear about the car, Im glad no one got hurt. Im guessing if the unibody frame is good they probably wont total it (which kinda sucks on an 8k mile car)

If I watch youtube videos on road rage, after about 15 minutes I can actually feel my blood pressure go up. I feel sorry for all those truck drivers that have to leave room for themselves to stop and all those cars that want to cut in front of them without turn signals to get ahead of traffic.

People can get hurt pretty easily with 2 tons of steal going down the highway.

Rule #1 - ALWAYS report accidents to your own Insurance Company.

Let THEM do the arguing over who's paying for what. Talk to THEM only about the accident.

Don't try to be your own advocate/Atty. to argue a case against an opponent's Ins. Co., you'll end up with less every time as a 'little guy' against the large company (not ALWAYS, but the chances are there, seen it regularly).

You do NOT save by trying to hide accidents from your Ins. Co. by going after the 'at fault' driver/company yourself, and you can LOSE a lot by not reporting.

I had a guy sideswipe me a few months ago, and he ran away. I chased his ass down and got his license plate. I'm sure if the cops knew I was doing 90 around town to catch up to this guy they would have given me the ticket lmao. But they were able to catch him and gave me his insurance info and whatnot.

I hope things get taken care of in a timely fashion.

And I thought getting a rock chip the other day was a big deal.......... Got a bullseye about fifty cent piece size. My insurance company claims they can repair cracks up to 7 inches as well. That seems a little sketchy.

Update: Nearly two months later and nothing has been done. Nationwide (his company) has been giving me problems. In West Virginia you can claim damages if the other driver is 51% or more at fault. In an accident, fault is determined by who got ticketed according to WV law from what my wife's lawyer told me, and I am entitled to diminished value on the car.
Nationwide is claiming that they can not determine fault, that the tickets the other driver received were not from the accident and have been stonewalling me at every turn. At this point I am going to file a complaint with the West Virginia insurance commissioner and will have to go through my insurance as gas is killing me on my commute. I will pay the $1,000 deductible I have and hope to get it back when all of this is settled.

Why don't you have your insurance handle the claim with Nationwide? They should be able to get things done.

He is. He's going to pay the $1000 deductible.

On a side note, my wife also got to an accident. The guy hit her from behind while she was waiting for the light to turn green. The other insurance is taking forever so we decided to pay the deductible of $750 and let them deal with it.

Geico came out this morning, made the estimate and is having my car towed today to the local Ford dealer body shop that I wanted to fix my car. A+ so far for them.

Update: Car is ready as of today. Nationwide claimed that the charges against the other driver were not related to the accident and denied the claim. I went through Geico and can not state enough how great they have been. I found out today after their investigation that they deemed me 100% not at fault (WV determines percentages of fault) and that they are going to arbitration against Nationwide to try and recover the payout and my deductible. The evidence, damage and witness statement matched what I said happened according to the rep of which I had no doubt. My wife is still suffering from the effects of her severe concussion but that is for a separate thread. I will post pics when I get it back. Just glad to start to get this nightmare behind me.
