I got Email this morning:


Lawsuit: Ford PowerShift Transmission→

Ford’s PowerShift transmission is supposed to provide the fuel economy of a manual with the convenience of an automatic. But a lawsuit says it:

“slips, bucks, kicks, jerks, gets hot, stutters, harshly engages, has premature internal wear, sudden acceleration, delay in downshifts, delayed acceleration and has difficulty stopping the vehicle, which eventually leads to transmission failure.”

Other than that, it’s great.

The lawsuit is for those that “purchased or leased any 2011–2015 Ford Fiesta or 2012–2015 Ford Focus vehicle equipped with Ford’s Dual Clutch or PowerShift Transmission.”

Ford insists the transmission works correctly, but they’ve also issued multiple Technical Service Bulletins (TSBs) and Customer Satisfaction Programs to address its problems.

It’s almost as if they're hesitating and stuck between thoughts.

sure sounds like some one had the brass ones to step and file that one. hope it does go national forcing a forever fix. with a return in value of the car,
 
I don't know if Zimmerman Law firm is in any way to Kimmel and Zimmerman the Lemon Law specialists who represented me against KIA Motors with my new 2001 Kia Rio.
The car had maximum of 1 inch suspension travel between the bottom of the bump stops and the rear suspension cross member. It would bottom out in daily driving w/no one in the car but me over certain bumps. With 4 average sized people in the car it would be fully bottomed out on the bump stops and the only cushion you'd get would be from the tires and seat springs. they replaced the springs, shocks 2x. After 3x they said this was normal. they ended up buying it back.
I have just over 9200 miles on my 2014. I am hoping I have no issues but some of the nightmare stories I've read on this sight don't give me a lot of confidence in Ford if I do have problems.

Looks like the second class action has finally been filed, the only prev. one was filed in CA back in '12 IIRC on focus & fiesta.

Reasonably good timetable of actions in that read, BUT the initial TSB's couldn't have been in 2010 as listed. Initial use was in 2011 for the fiesta here and focus in Europe, focus here in 2012.
 
stooge, wanted to say,, most shift fine for 10k,, mine did. then ,well you know the rest of the story... i would like to know how to join the law suit, i do think its the only way to deal with this defective trans,, let a judge decide. steve
 
I bet there will be a settlement if anything at all. I would think it will probably be rolled out as a trade in assistance for concerned owners on a new Ford vehicle.
that they did on my 2013 escape after the 1.6 kept puking antifreeze
10k to a new one of which lemonlaw dot com took a third leaving me with a 15k trade on a 2 year old 30k car and a 9k car loan

I dont know that I would go around saying you will get a buy back if Ford looses , that would be the first time in Ford History that has ever happened and that is not what Zimmerman people told me

well tom, i cant understand why they would tell each of us something different. that is very puzzling, now i see you have a interest to reprogram fords mistake and try to make it better , but i want out;;;;;;;;;;;;;;;;;; if i was told at the begging this was a defective transmission i would not of bought it, i am sure your interest is to try and find a fix., but its time to step up, as i said before all with this defective trans call the number i stated and see what they tell you,,, good luck all;;;;; steve
 
The DCT isnt defective , we have been over this before , The attorney will never be able to prove that the DCT is defective because it isnt
If thats what he is going for that going to fail right there

I did call the Number and I wasnt told anything about a buy back , I will call again tomorrow

tom,, please follow sailors link, we would like you on our side, this has been wrong from the start, and its time for it to stop,, i do look forward to a buy back at sticker price plus, many other compensations, as we deserve. then i will decide whether to buy another ford or not,, steve
 
Here's what was asked for in the suit according to a Chicago news source:

The plaintiff requested the court prevent Ford from selling any more vehicles with PowerShift transmissions without informing potential buyers of the defect; force Ford to replace the class members’ transmissions with a “suitable alternative;” award compensatory, exemplary and statutory damages, including interest and the $1,095 each buyer paid for the transmission; award full restitution or the profits Ford received through the sale or lease of 2011 through 2015 Fiestas and Focuses; and pre- and post-judgment interest and court costs.

They aren't asking for what you want, "full buy back" isn't on the table.
 
when ford is fased with this, it will be cheaper to buy back, then resell these cars used with no warranty, who knows they might even make money on the deal. other wise they will have to replace every trans, with a wet one,, not gonna happen. steve
