So I was recently on fswerks website and looking at their turbo kit for the 07-11 focus and it was saying if you don't complete the the waiver process or your order won't be shipped.

Is that just so the won't get in trouble by the epa?

Yes but it wont help them is some one gets caught they will still get in the same trouble because it still alters the CAT and other emissions , same as a waver saying your a off road use only and still cant turn off the rear o2

Im sure they will sell it to you , I have a better Custom Tune for there Turbo kit

If they have it for sale and you agree to the waiver, I don't see why they wouldn't sell it...that's their business model
