This lawsuit does not affect Canada.

Did early model Canadian Focuses not get the warranty extension on the transmission (at least, I thought it was an extension on the transmission and not just the TCM)? If it did, you shouldn't have to pay to replace anything and many people (myself included) have noticed vast improvement with the latest revision (B) clutch assembly.

Go to the dealer as said above. It should be covered.

However, the process will be a bit different because you are over 100000KM.

They will say you need to pay 1 hour of diagnostic, but, if they conclude the clutches and/or TCM is the problem, it'll all covered under warranty.

I have 196k miles on the car.
Its a 2012
Do I have any option under this lawsuit/recall?

I'm guessing this is a joke or a mistake. TCM and clutch go out at almost 200k miles? That's wear and tear.

Correct, which is stupid. Blows my mind that such a small, short window was agreed to. Many people have and will meet the same criteria, but because of the short window will not be covered under the class action.

I'm not familiar with class action law (or any law, really), so I don't know if this class action precludes another class action to cover those who were - at the time - ineligible for compensation, but with Ford getting hit with these DCT lawsuits in other counties (as they should, being that they intentionally misled customers and then continue(d) to push defective firmware/hardware), I'm hoping this wasn't a one-and-done type of thing.

I have 78,000 on my 16 without even a flash. Mine has maybe 90% interstate driving. It would shudder a little going into second gear. If I let off and let it seat into gear all the way then got back into it it stopped. I also would always run the rpms up to 2500-3000 for shifting.

I was replying to an earlier post. Don’t know why it put it in the end.

Canadian update: Registration for the Charney class action suit closed off long ago. The separate Quebec case is on hold, to be either lumped in the with Charney decision - scheduled for March 18, 2019 - or at least until after that decision is made for the rest of Canada.

Total compensation is capped at about $5825, per car, but that seems to be for those who have had multiple replacements, and dealer visits. Ford extended the warranty on the transmission to 160,000 km some time ago. Somewhere between my second and third reflash I joined the suit, and later had the clutch pack/TCM replaced. I believe that a very small percentage of Canadian Focus and Fiesta owners have registered. In 85,000 miles there have only been two issues over about 7 days of use where my wife would not/could not/was terrified to drive the car, a record of reliability which my 55 TR2, 74 Fiat Spyder, 82 RX-7, 88 Accord, 03 Protege could not match. I still like the car, but would be happy to get $500 - 2,000 for a car that has a very low resale/trade-in value...even if we have no plans to get rid of it.

No, you are in the Vargas settlement unless you opt out. I have the card handy:
"If you do nothing, you will be part of the Settlement and you will be able to claim benefits if the Settlement is approved by the Court...."

Now if your repair was performed before December 2017, yes, the deadline to make a claim on that repair has passed, but current repairs can make a claim within 180 days...
