There's certainly a lot of form space taken up by them referring to their fees or protection of. The reference to the tax would be enough to put me off. Good work Sherlock...I mean Sailor.

I officially rejected their offer. I simply noted that after reading the agreement, I pass.
There will no doubt be those who will be hoping to "hit the lottery" with the attorney's offer. Free money is always a sure way to lure some in. Too many loopholes and much to lose for me.
On the other hand, when I purchased this Focus, I did not sign up for annual clutch replacements. After 5 years since the onset of this issue there is zero excuse not to have a permanent fix that does not include getting another car.

This website provides you with important information with respect to the Settlement, and the website will be updated as new information becomes available.
If you purchased/leased a Ford Focus (2012-2016 models) or a Ford Fiesta (2011-2016 models) equipped with a PowerShift dual-clutch automatic transmission, you might be eligible for the following benefits, among others:
Repurchase of your vehicle through an arbitration procedure
Cash Payments totaling up to $2,325
Discount Certificates of up to $4,650 toward a new car purchase

Current status of this matter:

The parties in Vargas v. Ford Motor Company, C.D. Cal. Case No. 2:12-cv-08388-AB-FFM, have reached a nationwide settlement which was granted preliminary approval by the Court on April 25, 2017.* A copy of the Settlement Agreement is available under the “Case Documents” Tab on this website.
Notice will be mailed to known potential class members in early July, 2017. *
Class members cannot yet file claims for benefits under the Settlement.* Claims for cash payments or Vehicle Discount Certificates will be accepted after the Court grants Final Approval of the Settlement.* Please check this website frequently for updates regarding the Settlement

Today I received in the mail TWO postcards (for my 2012 I traded in, and for my 2014 Focus) about the settlement for the transmission problems.

But since BOTH of my cars have/had manual transmissions...
WTF??
I guess they sent out all Focus owners postcards...
Anyway, I bet YOU TOO will get a postcard, or two...

This was on FMC dealer and is Vargas not Stern so I'm not sure what I am going to do. I wish they would come out with an English English version so us non lawyers could know exactly what we would be getting with who. I just want fair compensation since I will be out of clutch warranty in 3k miles.

We've owned our Focus since 2013, bought new, other than the trans it's been a decent car with 52K miles on it. But sadly, it's in the shop today for the very same issue that's plagued this car since new, grinding sounds, jerky drive, etc.
As this car is a extra vehicle we use for jaunts to customers there is no specific driver that drives it all the time, but in this case it's good as every driver has experienced the same issues, on the other hand it's bad as it's out of site out of mind.
We never got a card for the lawsuit, but we had several day's of mail that some how never got delivered and the time frame is about right for delivery.
Did not get a call from Stern, but did drop them a line find out what they are about, just another attorney looking to cash in I'm pretty sure.
So, based on the info, we'll file a lemon law claim against Ford, as we've got doc's showing many visits regarding the transmission, and obviously the failure of a long term fix. In this case it's in our best interest to move forward beyond class action lawsuits or in this case Mass action and try and recover what's in our best interest, not some High Charging Lawyer looking to get wealthy.

Yes, it's called cashing in, I'm sure you expect to earn a substantial paycheck how that pans out for the others in the Mass Lawsuit, I have no clue. So, settle down and try not to be to righteous, you are an Attorney.

Here's a Joke to break the ice, what do you call a boat load of Attorney's at the bottom of the ocean???

The response was not intended to target you in particular - in fact, more for the people some months back. Definitely consider your options. Even if you don't choose to work with us, we recommending Opting Out because the class action settlement is so limiting in its options while completely narrowing your compensation options. To be clear, though - we do not get paid for anything that isn't a successful claim and not a dime comes out of our client's award or wallet. We bill Ford solely for the hours worked and no client is 'forced' into a settlement. They would need to accept the terms before we'd commit them to any offer so there's not any instance where the owner would be caught offguard or placed in a bad deal.
