Actually...

You might be able to do a stealth CAI in an 08-10 but I'm not sure if the 08-10 stock airboxes are like the 05-07. The stealth CAI retains the hydrocarbon trap and emissions stuff in the resonator so I would think it'd pass emissions testing. All you would need is a cone filter and the tools to get that airbox out. Check out Blazing_CopperZX3's website tutorial here and a Focus Fanatics thread about it here.

It's easy enough that even someone as incompetent as I am did it in like 2-3 hours. I'm using the K&N RX-4120 and the few days I've had it on its worked great.

I said screw it and bought the FSWerks. How often is emissions testing anyways? I got it done in July (I live in Connecticut).

I installed this a couple weeks ago. I do notice a power difference in the 3000-5000 RPM range, and it sounds a lot nicer. But interesting thing to note: on the FSWerks instructions, it said "if your vehicle's airbox doesn't look like this (picture of airbox), it is non-PZEV". My stock box didn't look like the one in the picture, so it took a bit longer to get out. Now on the window sticker from my car, which I inherited from the previous owner, it says, "PZEV emissions $0.00". Am I missing something?

with out seeing the pictures and what your box looked like, you can probably just mark that up to differences between the 05-07 and 08+..im sure the directions for the install were from an early 1.5gen focus
