Actually it is, a vendor cannot charge a Credit Card until the goods have shipped, but what they can do is authorize the funds (hold them), but they cannot charge until it's shipped. I work for Apple Computers and that's the way we do it.

So my bank account shows that charge as cleared.. meaning they have my money. right?

I called my bank and they said i had to file a schedule e form (funds/goods not received). I'll be going there today to get that done..

Yes, if it's no longer a pending charge then the funds have been received by the vendor (which, again, is against the law).

I don't think you jumped the gun at all. IMO, if a vendor gives you a timeline as to when a product is supposed to be shipped, they should stick with it. If there is a delay or change in ANY way, it should be the vendor's responsibility to send notification to the customer informing them of said delay or change.

It doesn't sound to me like he went out of his way to scam you...at least he was honest about it instead of constantly telling you "it'll ship out tomorrow or the day after" week after week, although I would think that as a vendor he should've offered you a refund if he doesn't have any parts in stock after a few weeks. Did you ever ask him for one?

^ i didnt mean to accuse him of 'scamming me'. I just meant to say that i got screwed.

I have asked for a refund.. with no reply. Then i got an "electronic notification of p/u" from the Post Office so i sent him another email saying nevermind.

It's now 4/30/08 still no rotors or shipping info. I ordered rotors from CFM on Monday.. they are in route as we speak. Woot !

I am sending him another email asking for a refund.. see how it goes.

Ok.. sent an email asking for a refund.

Got a response back.. refund submitted. He apologized for the hassles and all.. I understand he had issues but communication was not very good. So all in all, problem solved.
