Technically, we don't. There may be transmission fluid at the base of the bell housing, that's a red flag.
But based on the noises during gear changes and clutches slipping (with less than 36k miles) that other have had fixed, they had leaking seals that destroyed the clutch. So I can only say with a certain level of confidence that I'm also experiencing the issue.

So you go to the dealer and demand he replace the clutches and he says no. You tell him you're going to a lawyer. Based on what? An assumption.
I guess if you bring your checkbook the lawyer might show some interest. I also think going up against a company like Ford would probably be a losing proposition. For you, not the lawyer.
