Privacy/Confidentiality Breach?

Hey again people,

I may just be frustrated from my whole 'lending my car to my brother and having him write it off' process, but upon my insurance company calling dealerships to find prices for a comparable 2012 focus titaniums (I have replacement cost on my policy) they told the dealership my name, my phone number and that i'll be needing a new focus titanium. So I received a call on the weekend from a dealer over 180 MILES away informing me that "he's got my replacement car for me", I asked him how he knew of the accident and he said the insurance called him and was looking for the same car and said "ya go ahead and touch base with him", it was quite an aggravating phone call because it wasn't a replacement for me as it is a hatch when i have a sedan (my girlfriend HATES hatches so no offence to the hatch owners). I have a 5 year loan remaining on this and I don't want to get something that I don't want.

Anyways I blew up on my insurance company a bit telling them its unacceptable they provided my contact information to a SALESMAN. They did not even contact the dealer 4 miles from my house to get MY MARKET cost to replace (there is only one dealership in my town). If they call 10 dealerships for prices and give them all my name and number could you imagine how ing annoying that would be??

I'm just taking to the forum to see if I overreacted or if you guys would feel the same way I did?

I'm sure they can have a ti shipped in from somewhere the only question is whats your time frame? and you have gap insurance which is good. Do you have rental on your policy to? I know we do. I'd just go click LOL, so they totaled the old ti eh did you have frame damage?

In addition to the damage noted in my thread about the accident (2012 focus in accident, need some advice) they found transmission problems. I don't believe there was frame damage as the dealership said they did not find any.


I have a rental on my policy but I will lose it a few days after they offer me a settlement option, (I don't know how the gap insurance works whether they find me a car and I don't have much of a choice or they find me a car and say 'heres the money it would cost'), I don't like not having a choice!

Didn't they save you the time of finding an equally equipped replacement?
Had you looked for a replacement?

If you didn't look, this is part of the process, though the dealership calling you isn't part of the process. Insurance will often try to find the nearest equal vehicle according to your policy. If that happens to be further away than expected so be it. At least they know one is available somewhere in a short time period to get you back on the road quickly.
Weather they are willing to ship the car to you on their dime is up to them.you and you'll have to make some type of agreement on that point; and should call them to make arrangements.

I myself have never relied fully on my insurance to come up with a number to pay me. I do my own research and try to know ahead of time what they make offer so I can make a counter offer if I'm not happy with theirs. Not doing the same is just lazy IMHO.

Gap insurance covers the vechile if it's totaled I have gap on our insurance. How much do you think they are going to offer you? And they should pay the car off because its totaled and give you a check, at least thats how progressive is. When I rolled my 1997 gmc sonoma they obviously totaled it and they gave me a check and I went out a bought a 2002 s10 a week later :). Who's your insurance and why did they total it? and wow transmission problems in a 2012 wow...LOL sorry j/k :)

One thing we have to remember here is that he is in Canada. So the laws may be a bit different up there than they are for us here in the States. Giving out personal information would really irritate me as well, but they are doing their effort to find a replacement vehicle of what your car was valued at. If I were you, I would be going around trying to find another model that is equivilant to your.

I have located one in my city, thats why I do not see why they are expanding their search to a place 250km away, ps. it was written off from damage from an accident and hence thats where the tranny problem came from! They have not contacted the dealer in my immediate area (4 miles away) which i would believe to be the best option! the car is still exactly what i paid 6 months ago for it, so my replacement cost insurance endorsement will have to pay me what it costs to replace it with a similar model, as far as my understanding goes

The only way for the insurance company to get a rock-bottom replacement cost for your vehicle is to offer some 'quid pro quo' to them - a prospective buyer. I used to do this myself when I was settling total losses. Then again, that was before the internet was around and everybody became concerned about privacy issues.

Obviously, in this day and age, they should have at least asked your permission.

And if they didn't give you a quote on a sedan, it don't count.
(Although a quote on a hatch might be in your favor, because I believe they are in more demand...)

Since your car is under two years old, the insurance will cover the full cost of the vehicle. So what ever you paid for the car, money down, and whatever you have on the loan, you will be paid out. I'm from Toronto and I'm positive on this outcome. Now for your insurance company giving out your info, we in Canada have privacy laws in place. I don't know if they broke them, but I would find out.
