stupid courts system

ok need to vent here, back in november i illigally parked my car, i didnt realize it first. so whatever i maned up took responsibility and paid the 50 dollar ticket. by the time january rolled around the check still had not cleared so i looked up the number of the court house and got in touch with a lady who handles that department. so she pulled my record and found my check i had written and the ticket which i had signed and pleaded guilty to. she explained that it sometimes takes a while for the cop to send in the orginal paper work and to make sure i left the 50 dollars in my account.

ok so with that i figured i was alright and had nothing to worry about, BUT today i receive a letter in the mail saying notification of failure to respond.
umm yes i did respond retarded court system. i was supposed to respond by1/22/09 exactly 90 days from receiving the ticket which i did.

so now they are telling me i can face additional fines for not responding in time and possibly have my registration suspended and or have "Lien against your real and/ or personal property."

i dont even know if i can prove that i pleaded guilty anymore since i cant prove that i mailed the ticket in. the only way i can is if i show my checking account balance book.


this is probably how the court trys to make extra money, asshats

Well unfortunatly for you sometimes the best way to do business is to keep bothering them, when I have had problems with businesses or organizations I would call them every hour on the hour until they handled the situation, however when dealing with the governement it does you no good, because the people there are paid the same no matter what. So I feel for you, just be nice yet firm and explain that you did what was asked of you and dont take no for an answer.

Something like this happened to my dad only the court lost his check and it was in some ass clowns desk. My dad was pissed cause it was the only ticket he's ever gotten and it was for expired tags. The people at the court are f ing dumb as hell sometimes I swear.

unless the law has changed, in NYS the cop issuing the ticket has 30 days to file his supporting statement or else the ticket is void, i got out of a ticket 5 years ago by this law the cop didnt file his statement that he issued the ticket within 30 days and the ticket was dropped, now i dont know if this applies to parking tickets but if it does, you can claim you responded and that the court has the ticket and a check, and maybe the court still has the envelope you sent it in, then the postmark on the envelope would be proof that your replied within the time stated in the ticket.

call the court and ask them about it, if they give you problems get a lawyer, even if its just a parking ticket a few hundred is better than a suspended license

Well the letter is issued because most systems are automated. A ticket is issued with an accompanying court date which is electronically entered into the court system at the time the ticket is issued. If you do not show up at the time of the court date an letter is sent, depending on the initial offense it may just be a notice of a new court date, but that is all up to the judges discretion and determined when your name/case is called in the courtroom.

You should check with your bank to see if the check cleared. If it did they should be able yo give you the date when the city/county/state deposited the check. If they deposited the check (which is usually the day after it was received, greed) then it is a clerical oversight and does happen and you have nothing to worry about. If the check did not clear, bounced or insufficient funds, then you are to blame for your own misfortune, sorry, and you'll have to write another check. But if you keep a close eye on your checking balance you should already know if the check cleared or not.

Either way call your bank and the city/county/state to triple check the status of your payment. More than likely they will just tell you to disregard the letter.

If its at all possible always go pay a ticket in person and get a receipt. This is the end all in a situation like this. I have been there and done that
Same hods true with NJ DMV. They are worse than the courts at loosing stuff. I rode my harley around for 2 years with no registration due to a "paperwork" error. Their error still cost me an extra $70. Sometimes you just gotta throw your hads in the air and walk away for a while and come back calm then get it fixed.
