Modified Exhaust and Decibel Reading Citations
So at our annual neighborhood block party tonight, i had the chance to look at some police cruisers and patrol bikes that stopped by to get to know the neighborhood. I was talking with one of the officers and he was telling me about citing a biker with a loud modified exhaust for "modified exhaust." So the guy contests it in court and the judge ends up throwing it out because the officer didn't use a decibel reader to make the call, even though it was visually obvious that the motorcycle exhaust was modified, and the guy was even telling the officer about all the mods he had done.
Are motorcycles in California under a different emissions standard than regular vehicles when it comes to modified exhaust systems? The judge made his decision based on the sound only, and not what the guy had physically done to his motorcycle.
Is a "modified exhaust" citation for a regular vehicle like our foci contestable if the citing officer didn't use a decibel reader to make the decision? If so, even if he did a "pop your hood" inspection and saw long tube header or hfc?
