Well, my car is history!

I was in the hospital Thursday night and Friday morning. They gave me a sedative to help relax me while I was there. They told me I was good to drive when they released me. I was on my way home and needless to say that's what ended my cars life. I ran into a mailbox, hit a fire hydrin, and then hit someone porch. I will try to take pics of the car tuesday when I go to get my stuff from it from the tow yard. Basically the damages to the car are both air bags went off, the left wheel is completely off the axle, the windshield is shattered, and the right passenger side of that car is all dented in. The police officer had nerve to say "Oh, I don't think this is totalled!"

I am ok...... They gave me the last sedative about 2am in the morning and released me about 11 in the morning. I was still heavily sedated cause I blacked out.

Yeah, its not the hospital's fault for discharging a patient who's still sedated and then telling him that its safe to drive home. Do you read what you're typing? This has nothing to do with "personal responsibility," if a patient is sedated they shouldn't be discharged, and if they're going to be discharged they sure as hell shouldn't be told "yeah, you're OK to drive."

Its not like hospitals sending patients home as soon as they can kick them out the door without killing them is anything new. A friend of mine worked as a night-shift security guard at a few hospitals (they were all owned by the same company) and the worst case of this that he saw was a guy being sent home in a plastic neck brace with a potentially-lethal dislodged vertebra in his neck because they found out he was uninsured. He tried to walk home and was picked up by the police, who took him to another hospital, where they found out just how serious his condition was (had the dislodged vertebra in his neck slid another 1/2", he would've been paralyzed from the neck down...any further than that and he would've died) and treated him properly. The hospital my friend worked for ended up being sued for several million dollars in addition to being fined by the state medical board...although I'm sure that was just a case of someone shrugging their "personal responsibility" and filing a frivilous lawsuit against a hosptial that did nothing wrong, right?

I really think you have a solid case here for a medical malpractice and/or negligence suit. At the very least the hospital will most likely offer you a small settlement ($10,000-20,000) to just go shut up and not sue them. But if you wanted to take them to court I think (after attorney's fees) you could probably buy a brand-new car and have some cash left over afterwards...as suggested, I would at least consult an attorney (of the non-ambulance chaser variety, who will more than likely tell you yes to practially any case and then take 95% of the payout.)
