Focus -Power not customer friendly

I ordered a Diablo Predator Tune from Tom for a 2004 Focus SVT because I read on many post that the tune, will enhance drivebility on this focus, the only aftermarket item I have on this vehicle is an K&N air charger intake.
I sent Tom two money orders totaling $390.00 on March 21 07, he received the order on March 24. I waited a week before I called him. I called him on April 6 to let him know that I did not received the unit yet, his response was that it was sent already and that I sould receive it shortly. April 12 I called Tom again, he said that the unit was tracked by UPS and ended up somewhere in a UPS depot in New Jersey and that he already sent another unit and that I shoud receive either on Monday April 16 or on Tuesday April 17.
On Saturday the 21, I called Tom to let him know that the unit did not arrive and that I was not pleased that it was a month since my order and no tune. I said to him that I was not interested on the tune anymore because of how long it was taking, and that if the unit arrived this upcoming week, I was just going to refuse it and send it back for a refund. Tom got upset with this and told me that if I sent it back, I will have to wait until someone else would purchase the tune, because it was already tune to my car. Like I mentioned at the beginning, I only have a K&N AIR CHARGER, so I don't understand why I have a special tune that can not be changed?. He indicated that I should get in touch with UPS and track the order, that this whole mess is the UPS fault. I told him that I was not going to track the package because i did not sent it, at this point, during the conversation either we lost communication or he just hung-up on me.
Now I am not bashing Tom at all, from what I read on this site, he is a great guy, and that is why I decided to purchase his tune, but my experience with him has not been pleasent so far. I believe I'm entitled to a full refund after he receives the unit. Any toughts???

If you track it and determine he sent it out on when he said he did, it then becomes UPSs fault. I've never dealt with Tom, so there's no bias from me. You can't make the man suffer for the screw up of another company, all he's really obligated to do at this point is give you the tracking number and give UPS hell for making his business look bad.

The flasher has to be set to your ECU code, so he's not going to be able to just sell it to the next person who orders one unless their ECU matches your's. If its UPS's fault I don't see why you're blaming Tom for this, it sounds to me like he's gone out of his way to help you by sending you another flasher. When it shows up, why not just keep it?

BTW, if he sent you a UPS tracking number why not just go to their website and track it to see where it is? Does it take that much effort to copy and paste the tracking number into their web form and click the "track" button?

i had the same problem and it did infact turn out to be UPS that messed up. It took a month to get mine as well and tom sent me another one because ups had lost and broke it. He called ups himself and fixed the problem and followed up to make sure everything was good when i did get it. I bugged him for 3 weeks about it and he answered me and did everything he could to fix it. Im sure its all jsut a mix up with ups. Tom does whatever he can to help make sure your happy. so give the tracking number a try i bet youll have it on monday orr tuesday. toms a great guy he wouldnt lie.

It's not right to get mad at someone for a problem with the shipping company, once you have a tracking number you can go to their website (the shipping company) input the tracking number, and you can get a complete history of where the package was and when. A tracking number is for your benefit so you can know where your package is. If you think that's unreasonable, you probably shouldn't be purchasing anything that is delivered by mail.

the tune is not set up to my ECU code, I never was asked for it.
I do not have a tracking number to track the package.
I do most of my purchases through internet sites for my early broncos and for the focus.
Like I said before, I am not trying to bash Tom in any way, I'm not happy with how this transaction has turned-out.

It has nothing to do with the tune...for the flasher (the Predator) to be able to talk to your ECU it has to be set to the specific ECU code that your car runs on. Short of sending the unit back to the factory to be "unlocked" (and therefore paying a fee to do so) Tom will have to wait until someone with an identical ECU orders a flasher and tune.

so let me get this straight, the flasher will work only on a 04 svt??, by the way thank-you for your replies.

im curious now as well.

its not like an Xcal2? with the xcal, as long as its never been flashed, or if it has been flashed to stock, the tune can be changed to whatever tune you want.

once the predator has a tune, it cant be changed?



back on topic:

get the tracking number, and that will prove if it was shipped on the date that was given. If it was shipped on that date, it is entirely UPS's fault and not Tom's.

we dont know who to blame here, yet, till we get that tracking number.

First Tom didnt get mad about anything and i also didnt hang up on you , I thought you did me

Now that you brought this public , And thats your right , You have bought a Predator there will not be a refund now , There are ways to deal with things like this and ways not to and you chose the rought that in my opinion was not the proper one to take at this point

It would of been Diff if i refused to do anything at all and just left you hanging and you didnt have a Predator or any chance of your money back then it would of been time to come here , You had my cell and we talked about it , you have my PM and my emails and i have answered them it wasent like we were not trying to work something out and get this taken care of
