1. Depends on the cops, and no doubt their situation. Some will let it slide, some will happily nail you, some might only care when it's quota time or when they need an excuse. You're taking a chance. (Incidentally, your OP sounds like less than the limit. I assume you got the numbers reversed.)

2. No. I had window tint on my old Eclipse with a rear window defroster. The defroster itself never seemed to do any damage. The tint bubbled and looked awful eventually, but then, it often does, and did so on the sides as well. I would be more concerned about damage to the defroster wires, especially when you try to remove or replace the tint. (These weren't embedded in the glass, so just taking a razor blade to the window would have been a bad idea. I don't know how they're made on your Focus.)
