I understand. However, when I ordered the car, info was already out (if memory serves) that this would most likely be a late August/early September release. I can't say with 100% certainty that I would have ordered the ST2 if I had known about the HID issue back then, but at least 70% - sure. Like I said, it's cheaper and I do like the partial leather a lot more. I didn't say the situation was 100% comparable, but as similar as one could get, given the circumstances.
In your current situation, If I was the guy coming to buy your car, I would not back out of it even if I found one next door the day before coming. The only way I would back out of buying your car is if it was not as described. I might call and see if you had another buyer, and if so I would change my mind. AND if I was you, and someone went through the trouble of texting you a picture of the check and their bus tickets, I also would not sell it to anyone else until he didn't show up if that were to happen.
Right, most people wouldn't. And I definitely wouldn't sell to someone else - even if they offered me a grand more for it. I'm just saying that if he did spot one in his neighborhood and it was perfect for him, I'd understand. I wouldn't be happy, but I'd get over it. It's a free country. Maybe I'm just nonconfrontational, but I see no added value in giving the guy a piece of my mind.
Now- your sales guy that blew up on you was totally not cool but I can certainly understand your frustration. If I was in their situation, you would not be getting your deposit back. Now if you lost your job or had some other reason that you could no longer afford or buy the car, I'd be a nice guy and give it back. But you got so excited that you couldn't wait a few more weeks for the car that you yourself had the dealership buy to sell exclusively to you? I would definitely make the deposit non-refundable.
That's pretty much my only complaint about the situation - the way he handled it. As far as the deposit is concerned - from everything I've read recently, the deposit is refundable by law, so there is no such thing as "you would not be getting your deposit back". They have no legal right to not refund it, not having originally stipulated it as non-refundable (and I'm not 100% positive they would have the right to do that, either). Now, it's up to me whether or not I want to make it worth the guy's while for having worked with me. And had he been more gracious, I would have. Heck, I was still considering it and asking people what the right gesture would be after he blew up at me, but I was that much less inclined to actually go through with it. Also, from the standpoint of an "exclusive order"...come on. It's not a Bentley and it's not like the car had my initials engraved into the seats. It's one of what is a rather finite number of trims that, chances are, someone else will gladly take off their hands.
